NPRA is pleased to announce an important one-day conference: “CFATS Seminar: Understanding and Implementing the DHS Chemical Facility Anti-Terrorism Standards Program,” designed specifically for NPRA owners and operators in the petroleum refining and petrochemical manufacturing industries. Taught by seasoned security professionals, the CFATS Seminar will train facility security officers on how to meet their responsibilities under the new regulatory regime.
Why attend? Section 550 of the “Homeland Security Appropriations Act, 2007,” provided the Department of Homeland Security (DHS) with authority to regulate security at what are deemed “high risk” chemical facilities in the United States (the term "chemical facilities" here includes refineries). The law requires these “high risk” facilities to perform Security Vulnerability Assessments and develop Site Security Plans, and to submit them for approval to DHS.
At a minimum, facilities will have to complete a “Top-screen” risk assessment which DHS will make available through a secure DHS website. The Department will use this methodology to determine if a facility presents “a high level of security risk.”
DHS issued an Advance Notice of Rulemaking, titled “Chemical Facility Anti-Terrorism Standards” (or “CFATS”) in December of 2006, and the Department is to have these new regulations published no later than April 4, 2007. If DHS follows the proposal it outlined in December, facilities that are notified they are “high risk” will have 60 days in which to file Vulnerability Assessments and 120 days in which to file Site Security Plans. The Department (or when appropriate, a DHS-certified third-party auditor) will follow up with site inspections and audits.
