The paper examines the origins and challenges facing the oil industry as a result of the Clean Air Act Arnrnendments (CAAA) of 1990. The Act requires OSHA and EPA to develop regulations and programs to prevent an accidental release and to minimize the consequences of a release of a regulated substance. The CAAA are the basis for the Process Safety Management standard promulgated by OSHA in February 1992. By reviewing the legal requirements, the lessons learned during the implementation of process safety management serve as a foundation to understanding the potential impact of the EPA’s proposed rulemaking on Risk Management Programs for Chemical Accidental Release Prevention.
