On March 7, 1990, the EPA promulgated standards for benzene waste operations. The fmal rule was issued in January of 1993 with a two-year waiver for compliance. The National Emissions Standards for Hazardous Air Pollutants (NESHAP) for benzene has a major impact on U.S. refining: The rule applies to at least 48 refineries in the U.S. that emit more than 10 metric tons (10 Mg) of benzene per year. The API estimates the cost of this rule to industry at $1.25 billion. Twenty refineries were in compliance by April 7, 1993, and the remaining 28 applied for the waiver.
