Description:

Facilities with good environmental compliance records and systems are eligible to apply the FOA concept to manage their corrective action obligations in Texas. The FOA option is currently available only to chemical manufacturing plants and petroleum refineries. It allows such facilities to define a FOA to contain the infrastructure for the development, manufacture, process, transfer, storage and management of chemical or refinery products, hazardous materials, substances and wastes. Texas Risk Reduction Program (TRRP) provisions can be modified and/or excluded within the FOA (which generally contains the bulk of the corrective action units) until facility manufacturing ceases. However, FOA facilities are obligated to attain TRRP performance standards outside the designated FOA boundaries in the event that chemicals of concern (COCs) migrate out of the FOA.
