The Environmental Protection Agency (EPA) published the New Source Review (NSR) reform package in the Federal Register on December 31, 2002. These new rules are designed to offer facilities greater flexibility to improve operations and to remove regulatory barriers to improve energy efficiency and pollution control projects. With input from federal, state and local regulators including the Environmental Protection Agency, California Bay Area Air Quality Management District, Colorado Department of Public Health and Environment Air Quality Division, Montana Department of Environmental Quality Air and Waste Management Division, Utah Division of Air Quality, and the Washington State Department of Ecology Stationary Source Program, we navigated the early transition process related to the recently adopted reforms. Working with permit writers and planners from state and local agencies, we explored the unchartered territory of implementing the revisions to the NSR program and how it might affect current and near term capital projects at refineries. For regulated facilities, the lack of certainty inherent in the NSR process is increased dramatically for the near term. The timing of implementation varies from state-to-state and local agency to local agency depending on whether their program is a delegated NSR program or a SIP-adopted program. Agencies will also vary their approach to implementation depending on their own existing rules and regulations. In addition, more changes to the NSR rules are currently being proposed. Finally, litigation challenging the new rules on substantive grounds is already occurring and will most likely delay implementation of the revisions.
