The last twelve months have been an unusually active period for New Source Review (“NSR”) Litigation Court judgments. Of particular interest to NPRA members were the settlement of: · Chevron U.S.A. Inc. (“Chevron”) Consent Decree; · State of New York v. U.S. EPA; · U.S.A. v. Alabama Power Company; and · U.S.A. v. Duke Energy Corporation. In addition, NSR regulation reform also moved along, though at the slow rate that has been present for the last thirteen years. Of most interest was the U.S. EPA reconsideration of the Routine Maintenance, Repair, and replacement (“RMRR”) regulations. This paper will discuss each of these issues and present recommendations for NPRA members involved in Refinery Global Settlement discussions and anticipating NSR permitting.
