PM2.5 New Source Review (NSR) implementation issues present special challenges for the refining industry. NSR is a preconstruction review program that requires the installation of state-of-the-art air pollution controls and detailed atmospheric impact studies prior to the construction or modification of most significant sources of air pollution, including many operations in the oil and gas industry. In areas that attain the PM2.5 National Ambient Air Quality Standard (NAAQS), the relevant NSR permit program requirements are represented by the Prevention of Significant Deterioration (PSD) regulations found at 40 CFR 52.21 or in an approved State Implementation Plan (SIP). In areas that fail to attain the NAAQS, the governing NSR requirements, known as Non-Attainment NSR (NaNSR), are found at 40 CFR 51, Appendix S and apply until EPA approves equivalent state regulations into the governing SIP.
