For almost a decade U.S. petroleum refiners have been tracking the long and litigious rulemaking process for the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Industrial, Commercial, and Institutional Boilers and Process Heaters, which is better known as the Heater and Boiler MACT Rule (H&B MACT). On March 11, 2011, EPA issued what was supposed to be the final major source H&B MACT, which is codified at 40 CFR Part 63, Subpart DDDDD (the 5D Rule). On the same date, EPA issued the area source H&B GACT Rule, which is codified at 40 CFR 63, Subpart JJJJJJ (the 6J Rule). Because the vast majority of petroleum refiners are major sources of Hazardous Air Pollutant (HAP) emissions, this paper focuses primarily on the major source H&B MACT (the 5D Rule). A brief discussion of the 6J Rule is provided for those small refiners that are area (minor) HAP sources.
