EPA’s residual risk program has long been a source of interest and concern for the regulated community. This is more pronounced for petroleum refineries, as EPA has been performing refinery residual risk assessments for over a decade. On June 30, 2014 (79 FR 36880), EPA published their draft residual risk assessment for petroleum refineries, along with their proposed actions resulting from the assessment. This paper reviews the statutory basis for this residual risk program, along with the approaches EPA used to address the related Clean Air Act (CAA) requirements for Refineries. In addition, a case study is presented where ERM conducted an in-depth evaluation of the EPA risk assessment for a refinery.
