After decades of working on and refining it, EPA’s §316(b) Rule was promulgated 15 August 2014 in the Federal Register (Vol. 79, No. 158 p. 48424-48439) and became effective 14 October 2014. EPA made substantial changes in the final Rule based on numerous comments received on the draft that was published in April 2011. In this paper, I will summarize key elements of the Rule, particularly as they are likely to affect the Refinery or Petrochemical sectors. Certain aspects of the Rule require descriptions of the Cooling Water Intake Structure (CWIS), plant operations, and performance. Because these requirements will be relatively easy to address, I will not discuss them in this paper. Instead, I will concentrate on those aspects of the Rule that require biological monitoring along with brief discussions of other problematic aspects of the Rule (e.g., Benefits Valuation Study, Peer Review).
