The U.S. Environmental Protection Agency (EPA) is engaging in a multi-year study of the Petroleum Refining industry, which could likely result in the Agency concluding that it will revise existing effluent limitations guidelines (ELGs) for the industry. 1 This paper provides brief background and insight into EPA’s ELG process gained from many years of representing industries targeted for and subject to ELG studies and also rulemaking activities. This paper provides insight into: preparing for EPA’s ELG information collection effort; EPA’s typical ELG rulemaking pathway; and some of the critical issues associated with ELG rulemakings. It identifies the current events of the EPA’s efforts to evaluate the refinery industry and likely future events and schedules.
